Privacy Policy
Last updated: June 10, 2026. Prepared in accordance with UAE Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL).
At MSM Document Clearing Services, we are committed to protecting the privacy and security of your personal data. This Privacy Policy describes how we collect, use, process, and protect your information when you use our website, consult with our advisors, or contract our services for business setup, visa processing, typing, translation, or document clearing in the United Arab Emirates.
1. Compliance Framework
We process all personal data in strict compliance with the laws of the United Arab Emirates, specifically Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL), as well as relevant regulations issued by the UAE Department of Economic Development (DED), the Federal Authority for Identity, Citizenship, Customs and Port Security (ICP), and other local government bodies.
2. Personal Data We Collect
To facilitate government filings, company formation, and visa typing, we must collect sensitive personal documentation. This data includes:
- Identity Information: Passport copies, Emirates IDs, visa copies, passport-sized photographs, birth certificates, marriage certificates, and educational degrees.
- Contact Details: Full name, physical residential address, corporate address, active email address, and mobile phone number.
- Corporate Details: Existing trade licenses, shareholder details, Memorandums of Association (MOA), financial statements, and lease agreements.
- Payment & Financial Data: Bank account numbers, billing details, and transactional history with MSM.
- Government Credentials: Temporary login codes or OTPs shared to complete registrations on Tasheel, MoHRE, DHA, and ICP portals (used strictly for processing).
3. Legal Bases and Purposes of Processing
Under UAE PDPL, we process your personal data under the following legal grounds: to fulfill our contract with you, to comply with UAE legal obligations, or based on your explicit consent. Your data is used exclusively to:
- Establish trade licenses and register legal entities with UAE Mainland and Free Zone authorities.
- Process residency visas, Golden Visas, family sponsorships, and corporate work permits with ICP and MoHRE.
- Type and submit applications for Emirates ID registration and DHA/EHS medical fitness tests.
- Complete legal translations, certificate attestations, and MoFA approvals.
- Communicate with you regarding the status of your applications and government updates.
- Prevent financial crimes and meet AML/KYC requirements under UAE law.
4. Data Sharing and Government Submissions
To execute document clearing and business setup, we must share your data with authorized UAE government entities. This includes, but is not limited to:
- The Department of Economy and Tourism (DET) and various Free Zone Authorities.
- The Ministry of Human Resources and Emiratisation (MoHRE).
- The Federal Authority for Identity, Citizenship, Customs and Port Security (ICP).
- The Ministry of Foreign Affairs (MoFA) and foreign embassies for attestation.
- The Dubai Health Authority (DHA) and Emirates Health Services (EHS).
Note on Third Parties: We do not sell, rent, or trade your personal data to private third parties for marketing purposes. Data is shared with private entities only when necessary to fulfill a service (e.g., courier services for document delivery).
5. Cross-Border Data Transfers
Certain services — in particular certificate attestation and legal translation — require us to transmit your documents to foreign embassies, consulates, or ministries outside the UAE. Where personal data is transferred outside the United Arab Emirates, we do so only to the extent necessary to complete your requested service and in accordance with the cross-border transfer provisions of UAE Federal Decree-Law No. 45 of 2021 (PDPL), ensuring an adequate level of protection or your explicit consent for the specific transfer.
6. Cookies and Website Data
Our website uses only essential technical storage required for the site to function (such as caching for performance). We do not use advertising or cross-site tracking cookies. Any analytics, if enabled in future, will be limited to aggregate, non-identifying usage statistics.
7. Data Retention
In accordance with UAE commercial and tax laws, we retain your data only for as long as necessary to fulfill the purposes for which it was collected, including legal, accounting, and government audit requirements. Standard document copies are archived securely and purged in line with our internal data lifecycle policy once the transactions are complete and the relevant legal limitation periods have expired.
8. Security Measures
We implement strict physical, administrative, and technological security controls to guard your personal data against unauthorized access, loss, alteration, or disclosure. Physical document archives are housed in restricted areas, digital files are encrypted in transit and at rest, and access is restricted strictly to case-handling staff on a need-to-know basis.
9. Your Rights under UAE PDPL
As a data subject under UAE law, you possess several rights regarding your personal data, which you may exercise at any time:
- Right to Access: You have the right to request information about the categories of your personal data we hold and receive copies of it.
- Right to Rectification: You may request the correction of inaccurate or incomplete personal data.
- Right to Deletion: You have the right to request the erasure of your personal data under certain conditions (unless retention is legally required by UAE authorities).
- Right to Stop Processing: You may request that we suspend processing your data in specific circumstances.
- Withdrawal of Consent: Where processing is based on your consent, you can withdraw it, which may prevent us from completing active government filings.
- Right to Lodge a Complaint: If you believe your data has been handled in breach of the PDPL, you may file a complaint with us and, where unresolved, with the UAE Data Office (the federal regulator established under the PDPL).
